    Purpose of the Personal Data Processing Notice

    This notice on the processing of users' personal data (hereinafter: the Notice) applies to the website norms.rs and related websites, domains, subdomains, services, features, documentation, content, and applications (hereinafter: the Service), owned by an individual residing in the Republic of Serbia (hereinafter: “Owner,” “we,” “us,” or “our”). This Privacy Policy describes how we collect, use, share, and safeguard users' personal data. It also describes users' options for permanent data deletion.

    Personal data means any information relating to a natural person whose identity is determined or identifiable, directly or indirectly, in particular by reference to an identifier such as a name and identification number, location data, an identifier in electronic communications networks, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.

    Personal data is provided to us through registration and your use of the Account.

    Information and Access to Personal Data

    In accordance with Article 23 of the Law on Personal Data Protection (“Official Gazette of the Republic of Serbia”, No. 87/2018, hereinafter: the Law), fulfilling the duty of the controller as an individual toward the User, as the person from whom personal data relating to them is collected, the Service provides the User, at the time of data collection, with the following information:

      We are committed to respecting the privacy of Service Users. By accepting the Terms of Use, the User confirms that they are familiar with the Terms of Use of the Service and agree to their application. By using the Service, the User confirms consent to the collection and processing of the provided personal data.
      Data directly provided by users by completing the Registration Form, when creating a User Account or subsequently through use of the Service:
      • Account username
      • Account email address
      • Address (optional)
      • Company registration number (MB) (optional)
      • Company tax identification number (PIB) (optional)
      • Bank account number (optional)
      • IP address

    We have no obligation and no insight into verifying the accuracy, legality, or content of the data entered by the user while using the Service.

    Use of Data Processors

    For the operation of the Service, the controller uses the following data processors: Mailgun, DigitalOcean, Laravel Forge. The processors process data exclusively on behalf of the controller and in accordance with contractual obligations.

    Transfer of Personal Data to Other Countries

    Certain processors who may access personal data have their registered offices in foreign countries, primarily in member states of the EU or in countries that are parties to Council of Europe Convention 108. Data transfers to these countries are carried out based on the presumed adequate level of personal data protection in those countries, in accordance with the Law.

    If certain processors are established outside the above-mentioned group of countries, data transfer would be possible exclusively in compliance with Article 65 of the Law, which regulates transfers subject to the application of appropriate safeguards.

    Data Retention Period

    Personal data is retained as long as the User Account exists.

    Deletion of Personal Data from the Account

    Account deletion is final, complete, and irreversible: Log in to your account and click on “Settings.” Then click on “Profile,” where you have the option “Delete Account.” This will delete all account data.
    By deleting the account, data created by the User within user groups to which the User belongs (groups not created by the User) will not be deleted.

    User Rights

    1. In accordance with Article 26 of the Law, the User has the right to request access to data from the controller, the right to rectification and supplementation or deletion of the User's personal data pursuant to Articles 29 and 30 of the Law, the right to restriction of processing pursuant to Article 31 of the Law, the right to data portability pursuant to Article 36 of the Law, as well as the right to object pursuant to Article 37 of the Law.
    2. The User has the right to withdraw consent at any time, provided that withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
    3. In accordance with Article 82 of the Law, the User has the right to lodge a complaint with the Commissioner for Information of Public Importance and Personal Data Protection if they believe that the processing of their personal data has been carried out contrary to the provisions of the Law.
    4. The User has the right to submit a complaint. A complaint request may be sent to [email protected]

    Account Retention Policy

    For data security and privacy reasons, free accounts that are inactive for a period of six (6) months will be considered “phantom accounts.” Such inactive accounts will be scheduled for irreversible deletion. All data associated with these accounts, including personal data and all stored content, will be permanently deleted. Users are encouraged to log in regularly to retain access to their accounts and data.

    Information Security

    The controller applies appropriate technical and organizational measures to protect personal data from unauthorized access, loss, or misuse.

    If, despite all measures taken, a data security breach occurs, we will immediately notify all Users and take all necessary measures to mitigate the negative effects.

    How We Use Cookies

    The Service uses only essential (technical) cookies necessary for the proper functioning of the login system and Service security.

    Links to Other Websites

    Our website may contain links enabling you to easily visit other websites of interest. However, once you use these links to leave our site, you should note that we have no control over that other website. We are not responsible for the protection and privacy of any information you provide while visiting third-party websites.

    The authority responsible for the protection of rights related to personal data processing is the Commissioner for Information of Public Importance and Personal Data Protection of the Republic of Serbia. The competent court in the Republic of Serbia shall have jurisdiction over all disputes.

    Terms of Use

    Welcome to Norms. Please carefully and thoroughly read these Terms of Use (together with the Privacy Policy, hereinafter referred to as the Terms of Use) before using the website norms.rs and related websites, domains, subdomains, services, features, documentation, content, and applications (hereinafter: the Service).

    These Terms of Use govern the relationship between the owner of the Service (hereinafter “Owner,” “we,” “us,” or “our”) and you as a user of the Service.

    A user of the Service is the holder of a user account (Account) who meets the criteria set out in these Terms of Use and who has read, understood, and fully accepted the Terms of Use.

    Understanding these terms is important because by accessing or using the Service, you accept these terms on your own behalf and on behalf of any party you represent, including all others who use the Service under your Account.

    The following Terms of Use constitute a legally binding agreement.

    Development, Improvement and Updates of the Service

    We continuously develop new technologies and features to improve our services. As part of this ongoing improvement, we may add or remove features and functionalities, increase or decrease service limits, and begin offering new services or discontinue old ones.

    If we make significant changes that negatively affect your use of our services or if we discontinue a service, we will notify you within a reasonable period of time, except in urgent situations such as preventing abuse, responding to legal requirements, or addressing security and operational issues.

    Right to Modify

    We reserve the absolute and unrestricted right to amend, supplement, replace, suspend, or terminate these Terms of Use, in whole or in part, at any time and for any reason, at our sole discretion, without prior notice.

    Any such changes shall take effect immediately upon publication on the website or related services, or by any other method of notification we choose to use. Your continued access to or use of the Service after such changes constitutes your irrevocable acceptance of the modified terms.

    Right of Use

    If you use the Service as an employee, contractor, or agent of a corporation, partnership, or similar entity, you must be authorized to bind such entity to these Terms of Use, and you represent and warrant that you have such authority.

    By accepting these Terms of Use, you represent and warrant that (i) you are at least fifteen (15) years old, (ii) your Account has not previously been suspended or removed, and (iii) your use of the Service complies with applicable laws and regulations.

    Registration

    When registering an Account, you must provide accurate and complete information when requested and keep your Account information updated. You may not (1) select or use as a username the name of another person with the intent to impersonate that person, (2) use as a username a name subject to any rights of a person other than yourself without appropriate authorization, or (3) use as a username a name that is otherwise offensive, vulgar, or obscene. You are solely responsible for the activities that occur under your Account and for maintaining the confidentiality and security of your username and password. You may never use another person's account or registration information. Each user must have unique login credentials that may not be shared among multiple users. You must immediately notify us of any change in your eligibility to use the Service (including any changes), any breach of security, or any unauthorized use of your Account. You may never publish, distribute, or post login information for your Account. You will have the ability to delete your Account, either directly or by submitting a request to us.

    Use of the Service on Behalf of an Organization or Company

    Many organizations, such as businesses, nonprofit organizations, and schools, may use the Service. To use the Service on behalf of an organization:

    • an authorized representative of that organization must agree to these terms
    • your organization's administrator may assign you an Account. That administrator may require you to follow additional rules and may have the ability to access or disable your Account.

    Use of the Service

    The Service is accessed through a web browser by visiting norms.rs.

    By using the Service through a specific web browser, the User confirms that they have read the general terms of use of that web browser, understood their content, and accept that such provisions are binding, particularly including provisions governing the use of the web browser. We are not responsible for the operation of the web browser or for any consequences arising from or related to the User's use of the web browser.

    Use of the Service is free of charge, but use of internet infrastructure may be charged in accordance with the pricing of the internet service provider.

    The User uses the Service and the internet exclusively at their own risk. We provide no warranties and assume no liability for damages incurred while using the Service and the internet. The internet is an international computer network that we do not control, directly or indirectly, and therefore we do not guarantee the availability of services beyond our control.

    By using the content of this Service, the User accepts (1) all risks arising from such use and (2) that the content is used at their own responsibility.

    The User undertakes to do everything within their power to ensure that no one other than themselves gains access to their computer and that no one unauthorized views their personal Account on the Service.

    All actions performed using the Service shall be deemed to have been performed by the User.

    We reserve the right at any time to make changes to the Service or the services provided through it, including, without limitation, discontinuing some or all services or introducing new ones. We also reserve the right to fully suspend operation of the Service at any time. The User shall not be entitled to any compensation in connection with this. Changes of this nature will be published on the website norms.rs.

    Personal Responsibility

    The User is responsible for all activities conducted under their Account, including compliance with all laws relating to company personal and public data, privacy, personal information, international copyright, and trademark laws. You must obtain all necessary rights, permissions, and approvals to provide your data to us. Your data and its transmission must not violate any applicable local, state, federal, or international laws and regulations.

    Your Obligations

    You are solely responsible, and we disclaim all liability, for providing any services to your own users as part of your use of the Service, as well as for all obligations you have toward your users.

    Data Ownership and Access

    Account holders own all data generated under their Account.

    We will not access, modify, or distribute user account data.

    Account Retention Policy

    For data security and privacy reasons, free accounts that are inactive for a period of six (6) months will be considered “phantom accounts.” Such inactive accounts will be scheduled for irreversible deletion. All data associated with these accounts, including personal data and all stored content, will be permanently deleted.

    Users are encouraged to log in regularly to retain access to their accounts and data.

    Service Provision and Use of Data

    You hereby grant us a non-exclusive, fully sublicensable, worldwide, royalty-free copyright license to collect, use, copy, store, and transmit data solely for the purpose of providing services to Users.

    Data Limitations and Pricing

    We reserve the right to impose data limits and introduce charges for use of the Service as we deem appropriate for business purposes at any time without prior notice.

    Prohibited Activities

    You may not use the Service for any unlawful, fraudulent, or deceptive purposes. Without limiting the foregoing, the following activities are strictly prohibited:

    1. false representation and brand misrepresentation
    2. phishing scams and social engineering
    3. introduction of malicious software
    4. sending spam, hacking, or bypassing our systems or protective measures
    5. using our services (including the content they provide) to violate anyone's legal rights, such as intellectual property or privacy rights

    No Obligation to Detect or Prevent Fraud

    We do not guarantee the detection or prevention of fraudulent activities and assume no obligation to identify, investigate, or prevent unlawful conduct before it occurs.

    Consent to Communication

    By creating an Account, you agree to receive periodic communications from us regarding our services. These communications may be sent via email.

    If you choose to provide feedback, such as suggestions for improving our services, we may act upon your feedback without any obligation to you.

    Limitation of Liability

    Account holders agree to indemnify, defend, and hold us harmless from any liability and costs arising from the use of the Service. Account holders shall not initiate any claim or demand of any kind against us.

    We shall not be liable for any damages, including but not limited to indirect, incidental, or consequential damages, loss of profits, data, or ability to use the Service, regardless of the legal basis of liability, arising out of or related to the use or inability to use the Service.

    You are required to defend, indemnify, and hold us harmless from any losses, damages, liabilities, costs, claims, and proceedings arising from your use of the Service.

    Taking Action in Case of Issues

    Before taking the actions described below, we will notify you in advance when reasonably possible, explain the reason for our action, and give you an opportunity to clarify and resolve the issue, unless we reasonably believe this could:

    • cause harm or liability to a user, third party, or us
    • violate the law or a law enforcement order
    • compromise an investigation
    • compromise the operation, integrity, or security of our services

    You may always stop using the Service at any time. If you stop using the Service, we would appreciate knowing the reason so that we can continue improving our services.

    User Groups

    The Service allows the creation of user groups where users can collaborate on joint projects and share content. The user who creates a group is the “Group Super Administrator.” The Group Super Administrator may remove users from the group and manage user rights and privileges over shared data. All content created within the group belongs to the Group Super Administrator. If a user leaves the group, deletes their account, or is removed by the Group Super Administrator, content created by that user within the group will not be deleted. The Group Super Administrator may designate a user as a group administrator, granting them the ability to manage user rights and privileges over shared data.

    Deletion of Your Content

    If we reasonably believe that any of your content (1) violates these terms, (2) violates applicable law, or (3) may cause harm to our users, third parties, or us, we reserve the right to remove part or all of such content in accordance with applicable law. Examples include content that infringes the intellectual property rights of others.

    Suspension or Termination of Your Access to the Service

    Without limiting any of our other rights, we may suspend or terminate your access to the services or delete your Account if:

    • you materially or repeatedly violate these terms
    • we are required to do so to comply with a legal requirement or court order
    • we reasonably believe that your conduct causes harm or liability to a user, third party, or us — for example, by hacking, phishing, harassment, spamming, misleading others, or stealing content that does not belong to you

    About These Terms

    By law, you have certain rights that cannot be limited by a contract such as these Terms of Use. These terms are not intended to limit those rights in any way.

    These terms describe the relationship between us and you as a user of the Service. They do not create any legal rights for other individuals or organizations, even if others benefit from that relationship under these terms.

    If a particular provision is found to be invalid or unenforceable, this will not affect the remaining provisions.

    If you do not comply with these terms and we do not take immediate action, this does not mean that we waive any rights we may have, such as taking action in the future.
